Dear Mr. Nakao:

A search of the indices to the Central Records System as maintained by the New York Office of the Federal Bureau of Investigation revealed no records responsive to your Freedom of Information/Privacy Acts request on yourself dated Aug. 28,1992 and received in this office on Sept. 1, 1992.

Although no record responsive to this request was located, we are required to inform you that you are entitled to file an administrative appeal if you so desire. Appeals should be directed in writing to the Assistant Attorney General, Office of Legal Policy Attention: Office of Information and Privacy, United States Department of Justice, Washington, D.C. 20530, within thirty days of receipt of this letter. The envelope and the letter should be clearly marked "Freedom of Information Appeal" or "Information Appeal". Please cite the name of the office to which your original request was directed.

Re: Appeal No. 92-2741

Dear Mr. Nakao:

You appealed from the action of the New York City Field Office of the Federal Bureau of Investigation on your request for access to records pertaining to yourself.

You were advised by the FBI on September 3, 1992, that no records responsive to your request could be located in the indices of the central records system. It has been determined by my staff that its response was correct. Inasmuch as appeals can only be taken from denials of access to records which exist and can be located in Department of Justice files, I am closing your appeal file in this Office.

If you consider my response to be a denial of your appeal, you may seek judicial review in the United States District Court for the judicial district in which you reside or have your principal place of business, or in the District of Columbia, or in the Southern District of New York, which is where the search for records was conducted.
